Terms and conditions of sale

Article 1. Seller

These terms apply to sales made on wafmiou.com between Eden Wisniewski, sole trader, trading as Wafmiou, 67 impasse de Mareins, 46160 Carayac, France, SIRET 891 716 953 00049, contact@wafmiou.com, 07 69 64 73 92 ("Wafmiou") and any individual acting for non-professional purposes ("the customer").

Article 2. Products

Wafmiou resells designer furniture and accessories for dogs and cats, from European brands. The main features (dimensions, materials, recommended pet size, care, country of manufacture) are given on each product page. The photos are supplied by the manufacturers; slight differences in colour are possible. The products are shipped directly by the brands, from their workshop or warehouse in Poland or elsewhere in the European Union.

Article 3. Prices

Prices are shown in euros, VAT not applicable (article 293 B of the CGI). In France, delivery is free for orders of €69 or more. Below that amount, the cost is the one set by the shipping brand, €5 minimum. In the other countries of the European Union, the cost is the one set by the brand for the delivery country, €5 minimum, whatever the order amount. Very large furniture items have delivery costs even above €69. The costs are shown before the order is confirmed. The price that applies is the one shown when the order is confirmed. A crossed-out price is the lowest price Wafmiou charged in the 30 days before the reduction (article L112-1-1 of the Consumer Code).

Article 4. Orders

The customer selects their products, checks their basket, gives their details, then confirms the order with an obligation to pay. A confirmation email sums up the order. Wafmiou may refuse an order in case of a previous dispute or suspected fraud.

Article 5. Payment

Payment is made by bank card or by the other methods offered at checkout, through a secure payment provider. The customer's account is debited when the order is confirmed. Wafmiou never has access to bank details.

Article 6. Availability

Stock is held by the manufacturers. If a product becomes unavailable after the order, the customer is told within 2 working days and is refunded in full within 14 days at the latest, unless they accept an equivalent product.

Article 7. Delivery

Delivery is made to mainland France (excluding Corsica) and to the other countries of the European Union. In France, it usually takes 3 to 8 working days, and 10 working days at the latest. In the other countries of the Union, it usually takes 5 to 10 working days, and 15 working days at the latest. Details are on the Delivery page. The risk passes to the customer when the product is handed over to them.

Article 8. Right of withdrawal

The customer has 14 days from receipt of the product to withdraw without giving a reason (article L221-18 of the Consumer Code). The return costs are paid by the customer, except for a faulty product or a mistake by Wafmiou. The procedure and the form are on the Returns and refunds page. Wafmiou refunds within 14 days of being told of the withdrawal, and may delay the refund until it has received the product or proof that it was sent back.

Article 9. Guarantees

Wafmiou is bound by the legal guarantee of conformity (articles L217-3 and following of the Consumer Code) and by the guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).

The consumer has a period of two years from delivery of the goods to claim the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to show that the lack of conformity exists, not the date on which it appeared.

The legal guarantee of conformity requires the trader, where applicable, to provide all the updates needed to keep the goods in conformity.

The legal guarantee of conformity gives the consumer the right to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer gets a six-month extension of the original guarantee.

If the consumer asks for the goods to be repaired, but the seller imposes a replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction of the purchase price while keeping the goods, or end the contract and be refunded in full against return of the goods, if:
1° The trader refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular when the consumer finally bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;
4° The lack of conformity of the goods continues despite the seller's attempt to bring them into conformity, which was unsuccessful.

The consumer is also entitled to a reduction of the price of the goods or to termination of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to ask first for the goods to be repaired or replaced.

The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are unavailable because they are being repaired or replaced suspends the guarantee that remained, until the repaired goods are handed back.

The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code.

A seller who obstructs in bad faith the application of the legal guarantee of conformity faces a civil fine of up to 300,000 euros, which may be raised to 10% of the average annual turnover (article L. 241-5 of the Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the Civil Code, for two years from the discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept, or to a full refund against return of the goods.

Article 10. Product safety

The products sold comply with the applicable European rules, in particular Regulation (EU) 2023/988 on general product safety. The customer must follow the instructions, the assembly and care guidance, and choose a size that suits their pet.

Article 11. Personal data

See the Privacy policy.

Article 12. Complaints and mediation

Any complaint must first be sent to Wafmiou, at contact@wafmiou.com. In accordance with articles L616-1 and R616-1 of the Consumer Code, if the answer does not satisfy the customer, or if there is no answer within two months, the customer may refer the matter free of charge to the consumer mediator: CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, www.cm2c.net.

Article 13. Applicable law

These terms are governed by French law. The consumer keeps the protection of the mandatory provisions of the law of their country of residence. If no amicable agreement is reached, the competent courts are those set by law.
